TERMS OF USE
1. General Provisions
1.1. These Terms of Use (the “Terms”) describe the rules for accessing and using the public corporate website https://vpk-mac.com, including its Ukrainian- and English-language pages (the “Website”). The Website is operated by the legal entity identified in the Legal Notice / Company Information (the “Operator”, “Company”, “we”, “us” or “our”). A natural person visiting or using the Website is referred to as a “User”.
1.2. The Website presents public information about MAC HUB’s defence-technology activities, products, business directions, partnerships, news and opportunities for preliminary contact, including through the general contact and investment enquiry forms. “MAC HUB” is a commercial designation and does not, by itself, identify a single legal entity.
1.3. These Terms concern use of the public Website. They are not general conditions of sale, procurement terms, a product licence, a non-disclosure agreement or an agreement for the provision of defence products or services. Mere access to publicly available pages does not, by itself, establish acceptance of contractual obligations that require a legally valid form of consent.
1.4. The Legal Notice identifies the Operator; the Privacy Policy and Cookie Policy govern their respective data-protection subjects; and the Website Disclaimer explains the informational status of product, technical and investment content. Any applicable mandatory law and any valid, specifically concluded agreement prevail within their respective scope.
2. Access and Use of the Website
2.1. Users may browse publicly available pages and use the Website for lawful information, evaluation and communication purposes. Access does not entitle a User to restricted systems, unpublished information, accounts, software interfaces or other resources not expressly made available to the public.
2.2. Users must not interfere with the Website’s operation or security; attempt unauthorised access; introduce malicious code; impersonate another person; transmit unlawful or misleading requests; or bypass technical restrictions. Automated collection or requests that impair availability, circumvent security measures or unlawfully infringe the rights of others are prohibited.
2.3. Any use of Website materials remains subject to the intellectual-property rules below and to exceptions and limitations provided by applicable law. Nothing in these Terms prohibits lawful quotation, statutory permitted uses or other rights that cannot validly be excluded.
2.4. To the extent permitted by law, the Operator may reasonably restrict access associated with suspected security incidents, unlawful activity or material disruption. Such measures do not affect mandatory rights of Users or the Operator’s applicable security and data-protection obligations.
3. Intellectual Property
3.1. Text, photographs, videos, graphics, page design, databases, software elements, product images, names, logos and other materials displayed on the Website (together, “Content”) may be protected by copyright, trademark, database, industrial design or other applicable intellectual-property laws.
3.2. Rights in particular Content may belong to the Operator, another MAC HUB company, a developer, a partner, a licensor or another third party. Displaying material on a common Website does not establish that the Operator owns all Content or possesses the right to authorise every possible use of it.
3.3. Neither browsing the Website nor receiving a response to an enquiry transfers ownership of, or grants a licence to, any patents, designs, inventions, source code, confidential know-how, technical documentation or other proprietary technologies. Any licence or transfer must be granted by the appropriate rights holder in a separate valid arrangement.
3.4. Names, signs and logos appearing on the Website may be protected whether or not a registration symbol is displayed. Users must not imply endorsement, affiliation or authorisation by the Operator, a MAC HUB company or a partner without an appropriate lawful basis.
4. Use of Website Materials
4.1. Users may view Content and make incidental copies technically necessary for ordinary browsing. Limited saving, printing, quotation or use for internal evaluation is permitted only to the extent authorised by the relevant rights holder or applicable law, and must not misrepresent the source, status or context of the Content.
4.2. Unless an applicable legal exception or express permission allows otherwise, commercial republication, modification, redistribution, licensing, sale, use of protected imagery in promotional materials or incorporation of Website Content into a third-party product requires prior permission from the relevant rights holder. A request for such permission may be sent to the appropriate contact listed in the Legal Notice.
4.3. Publication of descriptions or images of armoured vehicles, unmanned aircraft, maritime systems, robotics, electronic equipment or software does not authorise reproduction of the underlying technology, access to non-public specifications, reverse engineering contrary to law or the unauthorised transfer of controlled technical information.
4.4. Public access to Content does not constitute confirmation that its use, disclosure or transfer to a particular person or jurisdiction is permitted under export-control, sanctions, national-security or other applicable rules. Any separate required permission remains the responsibility of the relevant parties.
5. Enquiries Through the Website
5.1. The Website provides channels for general, commercial, media, partnership and preliminary investment enquiries. Sending a message or completing a form does not, by itself, place an order, accept an offer, reserve a product, conclude a supply or investment agreement or oblige any MAC HUB company to enter into a transaction. Any legal commitment must arise through the applicable lawful procedure or a valid agreement with an authorised contracting party.
5.2. Users should provide accurate contact details and only information they are entitled to disclose. The Website’s public forms and ordinary email addresses are not intended for transmitting information constituting state secrets, restricted defence documentation, information on deployment or production-site locations, passwords or other sensitive technical materials. Where necessary, an appropriate secure channel and confidentiality arrangements are agreed separately.
5.3. Existing non-disclosure agreements and other binding confidentiality duties remain effective according to their terms. Submitting a lawful enquiry does not automatically assign intellectual-property rights, grant an unrestricted licence to use submitted ideas or render information non-confidential. Information provided may be used and routed only as legally permitted and as necessary to handle the relevant communication.
5.4. An enquiry may be forwarded to the relevant legally separate MAC HUB company or other appropriate recipient when necessary and lawful. Personal-data processing and allocation of controller responsibilities are described in the Privacy Policy. The Operator does not undertake to respond to every unsolicited proposal within a fixed period unless required by law or a specific commitment.
6. Relations with MAC HUB Companies
6.1. The Website presents several defence-technology directions, including armoured vehicles, unmanned aerial and maritime systems, electronics, demining, ground robotics and software. Business directions, product names and commercial designations must not be assumed to constitute separate legal persons.
6.2. Companies presented under or associated with MAC HUB, as well as independent partners, may have their own rights, obligations and legal status. The Operator does not become the manufacturer, seller, owner of intellectual-property rights, guarantor or contracting party for every listed product or project merely by operating the Website.
6.3. Specific commercial, research, licensing, procurement, investment or confidentiality arrangements are governed by the agreement entered into with the properly identified party and by applicable law. A separate group company is not bound by another entity’s statements or contracts solely because both are presented on the Website; this does not exclude responsibility imposed by law or expressly undertaken.
7. Third-Party Resources
7.1. The Website may include links to third-party websites, publicly available publications or externally provided content. Such resources are controlled by their respective operators. A link does not, on its own, constitute endorsement, sponsorship, a representation of affiliation or a grant of rights in the linked material.
7.2. External resources may operate under their own terms and privacy rules. Where third-party features on the Website involve processing of personal data or access to information on a User’s device, the Privacy Policy and Cookie Policy explain the applicable approach. These Terms do not authorise processing contrary to those policies or to mandatory law.
7.3. The Operator does not control independent third-party websites and is not responsible for their own content or technical operation except to the extent responsibility arises under applicable law or from the Operator’s own acts or omissions.
8. Operation and Changes to the Website
8.1. The Operator may update, correct, reorganise, temporarily suspend or remove public pages and Website functions for operational, legal or security reasons. Unless a separate binding commitment provides otherwise, the Website is not a guaranteed continuously available service. Mandatory duties concerning security, personal data and unlawful content remain unaffected.
8.2. Information about products, technologies, development stages, technical characteristics, availability and investment opportunities is addressed in the separate Website Disclaimer. General Website information must not be treated as a substitute for an agreed contractual specification, export authorisation or professional technical assessment.
8.3. Changes to these Terms will be published with the relevant version or revision date. Any changes operate prospectively to the extent permitted by law and do not amend existing separate contracts, withdraw legally protected rights or replace notices or consents required by mandatory law.
9. Applicable Law and Disputes
9.1. Subject to mandatory conflict-of-laws rules and non-excludable protections, these Terms and matters concerning the use of the Website are governed by the laws of Ukraine. Nothing here excludes rights that apply to a User under mandatory provisions of another jurisdiction where such provisions cannot lawfully be displaced.
9.2. Users may address questions or complaints concerning the Website to info@mac-hub.com. Disputes are resolved by courts having jurisdiction under applicable procedural law. These Terms do not, by themselves, require arbitration, confer exclusive jurisdiction on a court lacking legal competence or override dispute-resolution provisions validly agreed for a separate transaction.
9.3. If a particular provision is held invalid or unenforceable, the remaining provisions continue to apply so far as legally possible. Any invalid provision is not to be interpreted as limiting mandatory statutory rights or obligations.
10. Changes to the Terms and Contact Details
10.1. The current Terms and their revision date are available on the Website. The Operator may revise them to reflect legal requirements, changes in the Website’s public functions or legitimate operational needs, subject to the limits described above.
10.2. For general questions about the Website or these Terms, contact info@mac-hub.com. Commercial offers and cooperation enquiries may be sent to business@mac-hub.com, and media enquiries to pr@mac-hub.com. The Operator’s legally relevant particulars are set out in the Legal Notice / Company Information.
10.3. These Terms form part of the Website’s legal information together with the Privacy Policy, Cookie Policy, Legal Notice / Company Information and Website Disclaimer. Each document governs its own subject matter; none removes rights or duties established by applicable law.
